Important Steps and Timelines

Protect your rights. If you have been seriously injured, taking these steps immediately will protect you and your loved ones.

  1. Contact the proper authorities, such as the police.
  2. Note names of witnesses and people involved in the accident.
  3. Go see your family doctor about your injury.
  4. Record the names of all doctors and health care professionals who participate in your care in relation to your accident. Remember to include the dates of your visits.
  5. Keep receipts of all expenses related to your accident, such as medication; replacement clothing; assistive devices,
  6. Caregivers, such as family members or friends, should record their time spent participating in your care.
  7. Collect any insurance plans information that you may have rights to claim against, such as auto insurance, accident insurance, short and long-term disability insurance, etcetera.
  8. Be aware: Anything you say to your insurer could be used against you in determining your entitlement to benefits. Speak to a lawyer first.
  9. Contact a personal injury lawyer to discuss your legal rights.

Critical Timelines

If you or a loved one has been in an accident, there are time restrictions on making a claim.

  • Within 7 days of your accident:
    notify your accident benefits insurer of your accident.
  • Within 30 Days of your accident:
    apply for accident benefits.
  • Within 2 Years of your accident:
    Begin a tort claim against the party who is at fault for the accident. Make a claim against the insurer if you are denied accident benefits.
