What is a Non-Sufficient Fund Fee?

A Non-Sufficient Fund (“NSF”) fee is a fee charged if a payment is presented and there are not enough funds in the account to process the payment.

What is the Nature of this Class Action?

It is alleged that Simplii charges multiple NSF fees on one or more representations of the same transaction for payment.

It is alleged that Simplii makes these duplicative NSF charges when online vendors attempt to reprocess a single transaction. It is further alleged that this is a violation of Simplii’s contract with its customers and a breach of consumer protection legislation. 

Who is Included?

“Class Members” are proposed to include all Canadians who have or had a personal deposit account holder with Simplii Financial since November 1, 2017 and whose bank account has been charged multiple Non-Sufficient Funds fees by Simplii Financial arising out of one or more representations of the same transaction or payment.
