Birth Injury

Having a new baby is an exciting time, a time for much joy. When the hopes and expectations for birth are tempered by panic — medical professionals acting urgently to respond after something goes wrong — parents are left with many unanswered questions. In the aftermath of a complicated labour and delivery, the last thing a parent wants to do is question their medical team. We want to believe that our medical professionals did everything they could to prevent injury to their child. Sadly, the reality is that some birth injuries or complications may have been preventable. If you have questions regarding your child’s birth, diagnosis, or care after they’re born, or perhaps you have questions about something that may have happened prior to their birth, we are here to help.

Birth injury is a general term. It refers to physical and cognitive trauma experienced by a newborn prior to, during or just after birth. In many cases, upon learning of their child’s condition, parents are not given full details about what happened. The many medical unknowns add to the stress of anticipating life for a child with challenges and who may require long-term care

Some examples of birth injuries would include:

  • Brachial Plexus Injuries
  • Erb’s Palsy
  • Fetal & Neonatal Stroke
  • Hypoglycemia
  • Hypoxic Ischemic Encephalopathy (HIE)
  • Jaundice, Kernicterus & Hyperbilirubinemia
  • Meconium & Meconium Aspiration Syndrome
  • Negligent Resuscitation of a Newborn
  • Newborn Infections
  • Periventricular Leukomalacia (PVL)
  • Seizures
  • Trauma from Forceps & Vacuum

Many of the birth injuries listed above can result in a brain injury to the newborn. When infants sustain traumatic brain injuries, these injuries can often result in a diagnosis of cerebral palsy.Cerebral palsy (CP) is a physical disability that affects movement and posture. Cerebral Palsy is associated with (caused by) some kind of injury to the developing brain. The injury can occur in the womb, during the birth of the baby, or in the first couple of years after birth (usually because of infection or trauma to the brain).

Long Term Disability

Long-Term Disability policies exist to protect individuals who are unable to work due to a disability by providing an income replacement benefit. If you are unable to work due to illness, accident, or injury for an extended period of time, you may qualify for long-term disability benefits through your insurer. A personal injury lawyer can help you access these benefits if your claims are being denied or if your benefits are cut off while you are still disabled or recovering.

Each Long-Term Disability policy is different. To qualify for Long-Term Disability benefits, you will have to meet the eligibility criteria outlined in your individual policy. This will include meeting the definition of “disability” that is outlined in your policy. If you or a family member is off work due for an extended period due to accident, illness, or injury, we recommend that you consult with a personal injury lawyer as soon as possible. A lawyer can help determine if you have a potential claim against your insurer. Gluckstein Lawyers offers free consultations and can help you navigate through the complex area of Long-Term Disability law.

Class Action and Mass Tort

Class Action lawsuits are common where a large group of people are injured by the same party in the same way. The interests of the group are represented by one individual known as the “class representative”. The class is treated as a group that was injured, rather than a group of individuals that were injured. Rather than having each person bring his or her own lawsuit, a Class Action allows the group to collectively sue the at-fault party to resolve the claims in a single legal proceeding. A Class Action provides an efficient way to litigate common issues. A Class Action can focus on multiple areas of law, including personal injury and product liability.

Mass Tort

A Mass Tort action involves many injured parties against one or a few at-fault parties. Mass Tort actions are similar to Class Actions, however, a Mass Tort action treats each injured party individually, rather than as an injured group. It can be an efficient and cost-effective way to navigate the legal system for multiple parties experiencing the same or similar injuries. A Mass Tort action provides an efficient way to litigate common issues. A Mass Tort action can focus on multiple areas of law, including personal injury, product liability and medical negligence.
