On May 10, Ontario Provincial Police responded to an accident that killed two people and injured another. The head-on collision involved a tractor-trailer and a Chevrolet sedan, and both occupants of the sedan were pronounced dead at the scene. The driver of the truck was listed in stable condition at an area hospital after being taken from the crash site by ambulance.
The fatal truck accident occurred around 2:30 p.m. on Ontario Highway 401 in Chatham-Kent. Just west of Mull Road, the westbound truck crossed the grass median before hitting the eastbound Chevrolet. Police temporarily closed both directions of the highway, and the westbound lane was soon reopened. It was not stated when the eastbound lane was opened to traffic, but it was stated that the OPP Technical Traffic Collision Investigation team reported to the area.
According to Section 61 of Ontario's Family Law Act, when someone dies as a result of an accident, his or her family may seek compensation for their losses, such as the income that their loved one would have brought to the family. Noneconomic damages may also be considered in a claim, such as the lost companionship, guidance and care of the deceased.
Only certain family members are permitted to file for this compensation, those being grandparents or grandchildren or the spouse, children, parents or siblings of the deceased. If the accident was caused by the driver of a commercial vehicle, not only could compensation be sought from the driver but also from any companies that own or operate the truck.
